Cliff decided he wanted to sell his personal motorcycle. Cliff is also the owner of a car dealership. The motorcycle Cliff wanted to sell is not a part of Cliff’s regular inventory at the dealership and was not listed on the computer register for the dealership’s inventory. Cliff had a small parking space right at the front of his dealership and decided to park the motorcycle there with a FOR SALE sign that states, “2017 Rocket Motorcycle for sale. Low miles. Fast, fun, and in excellent shape. The first person to present $5,000 takes it. Call 1-800-USD CARS.” That is the phone number for the dealership. Brian is a used car wholesale dealer. Brian and Cliff have an exclusive business arrangement. Brian supplies all of Cliff’s vehicles that Cliff sells at his dealership and Brian buys all of the vehicles that Cliff accepts in the regular course of his trade. On Monday morning, Brian made his routine walk through Cliff’s car inventory to see what he wanted to buy and what he had on hand to sell. Brian immediately fell in love with the Rocket. Later that same day, Brian sent a fax (the fax and telephone was their usual communication method for business) to Cliff that stated, “I’ve always loved those Rockets. I’ll pay you 4K for it.” Cliff saw the fax and thought about the deal until the next morning when he sent a text message from his personal phone to Brian’s personal phone that said, “I need at least $4,600 on the Rocket.” Brian responded that day, by a telephone message to the Dealership’s message machine that stated, “I’ll pay $4,500 on the Rocket but I want a deal on that five car package we were talking about last week.” Cliff responded the following day, Wednesday, with a fax to Brian that simply states, “I guess we can do that on the deal.” On Thursday morning, a 17-year-old kid named Snot Nosed walked into the dealership and presented $5,000 to Cliff. The Rocket was sold to Snot Nosed on the spot. On Friday, Brian showed up with a car transporter for the five cars and a helmet to ride the Rocket home. Brian finds out the Rocket was sold and can’t believe Cliff screwed him that badly. Brian ended their exclusive relationship and didn’t buy the cars. At trial, does the court find a contract existed between Cliff and Brian?
